October 30, 2003 Press Release: Land Court Upholds Martha's Vine

In May of this year, Land Court Judge Peter Kilborn, sitting in Superior Court, ruled that the MVC was not a “local board” within the meaning of chapter 40B and had authority over 40B projects. In June, CK Associates filed a motion that claimed that the court had erred and asked it to amend its judgment on the basis of a March 2003 Supreme Judicial Court decision to the effect that the Dennis Historic District Committee was a local board.
